Sales Policies, Procedures, and Shipping Costs

Shipping Costs are determined AFTER your initial purchase of the artwork.
Due to the great variation in size and weight of individual pieces,
we cannot quote shipping costs until the item(s) are actually
packaged for shipping.

Our policy is to have the customer pay for artwork online using the PayPal system.
We will send an invoice to your email address.You then reply to the email from Paypal using your credit card information to make a purchase from the Dion Gallery.After the art is packaged, the actual shipping costs can then be calculated.
At that time, you will receive another email that will provide you with the actual
shipping costs and a final Paypal invoice will be sent. When the shipping cost invoice is paid, the artwork will ship.

Personal checks are accepted, but artwork can not be shipped
until after checks clear our bank.

Framed vs. Unframed Shipping

All art on the Dion Gallery web site comes framed. Occasionally, because of the
size and/or weight of a piece, a customer will request an "art only" shipment.
We are happy to unframe the artwork and shipping costs will be tremendously reduced, but we can not then discount the price of the art as the costs of the framing and matting have already been incurred by the gallery.

If you request an "art only" shipment, the disassembled mats, frames, glass, etc.,
are then not included in the sale and remain the property of the gallery.

The following terms and conditions govern our guarantee:

Definition of Authorship:
"Authorship" means the identity of the creator.

Guarantee Coverage:
If, within two months from the date of sale of any work of art, the original purchaser of record tenders to us in the same condition as when sold through us; and it is established that the identification of Authorship (as defined above) of such lot set forth by any posted notices during the sale is not substantially correct based on a fair reading of the posted notices or any materials produced and published by the Dion Gallery, the sale of such work will be rescinded and the original purchase price refunded. The buyer will be required to pay return shipping costs including mandatory insurance.

Non-Assignability:
It is specifically understood that the benefits of the Guarantee are not assignable
and shall be applicable only to the original purchaser of the art from us and not
to any subsequent owners or others who may acquire an interest therein. Proof of original ownership may be required.

Exclusions:
The Guarantee covers ONLY the correctness of descriptions of Authorship
but does not extend to titles or other identification of offered works of art
nor to the physical condition and size, quality, rarity, importance, provenance,
exhibitions and literature of historical relevance, which information may or may not appear on the Certificate of Authenticity itself. Although our best judgment is used in making descriptions and the appropriateness of glossary terms, and due care is taken to insure the correctness of the supplemental material(s) which appear on the Certificate of Authenticity, the Guarantee does not extend to any possible errors or omissions therein.

Sole Remedy:
It is further specifically understood that the remedy set forth within,
namely the recession of the sale and refund of the original purchase price paid
for the work of art is exclusive and in lieu of any other remedy which might
otherwise be available as a matter of law.

Appraisals:
Our appraisals represent our opinion of the retail price a client would have to pay
to replace the work of art from a reputable gallery.
We assume no liability for claims based on other appraisals of the work of art
that show an opinion of value higher or lower than our appraised value.
Therefore, we do not assume any liability for:
1) insurance losses based on a claim that our appraisal value is too low, or
2) claims for refunds or money damages based on a claim that our appraisal value is too high.

It is the Dion Gallery store policy that all sales are finalexcept as specifically outlined in the above Terms and Conditions.

No returns of any type will be accepted in person or by any carrier.
No refunds given due to Buyer's Remorse.
